When is a South Carolina employer required to purchase workers comp insurance?
Any employer who regularly employs four (4) or more workers full-time or part-time is required to have workers’ compensation insurance.
Does South Carolina workers compensation insurance cover corporate officers, partners and sole proprietors?
Sole proprietors and partners are considered owners of the business and are not automatically included under workers’ compensation insurance. They may elect to be covered if they are active in the business and have duly informed their insurance carrier.
Corporations – all employees are automatically covered, including the owners if they are also employees of the corporation. Owners and Officers can elect to excluded by completing a Form 5 .
Limited Liability Company’s (LLC) – All executive officers are automatically excluded for being covered under a WC policy. They may elect to be covered if they are active in the business and have duly informed their insurance carrier.
